BMExpert Application Terms of Service

These Terms of Service govern access to and use of the “BMExpert” online building management software platform (hereinafter the “Platform”). The Platform is operated and supported by the BMExpert team (hereinafter “We” or “Us”).
Use of the Platform constitutes unconditional acceptance of these Terms of Service. If you do not agree with part or all of these terms, please do not use the Platform.
1. Service Description
BMExpert is an online software (SaaS) that provides digital tools to facilitate the management of apartment buildings, complexes, and properties. Core features include, but are not limited to:
- Financial Management (Finances): Calculation, recording, and allocation of communal expenses, management of the reserve fund, and the ability to transfer expenses to tenants.
- Reporting (Reports): Creation and export of detailed reports on finances, collections, and the building's history.
- Building Profile & Location: Digital mapping, uploading of architectural plans and articles of association.
- General Assemblies & Minutes: Conducting votes (Votings) and officially recording assembly minutes.
- Document & Lease Management: Creating, archiving, and managing lease agreements and other documents.
- Maintenance Management: Internal recording and tracking of building maintenance needs.
- Communication & Announcements: Immediate notification of residents and owners on important matters.
The Platform operates exclusively as a technological organizational tool. It does not assume the duties of a physical property manager, does not intervene in assembly decisions, does not provide legal advice, and does not guarantee the collection of debts.
2. User Roles & Registration Process
Access to the Platform is granted through an invitation system, ensuring the hierarchy, privacy, and security of building data. The available roles are defined as follows:
- Management Company: Professional entities entrusted with building management. They enjoy full administrative rights in the system and the ability to oversee multiple buildings.
- Building Administrator (Admin): A natural person with full management authority over a specific building. They act either autonomously or in cooperation with a Management Company (where such cooperation exists for that building), bearing responsibility for sending invitations to Owners.
- Owner: A person associated with a specific property within the building. They retain the right to view announcements, minutes, financial details of their unit, and to participate in votes. They may redirect their unit's expenses directly to their tenant and invite them to the Platform.
- Tenant: Gains access strictly upon invitation from the Owner. They have the right to view information exclusively for the unit they lease, submit maintenance requests, and receive announcements. They have no access to votes or assembly minutes. Viewing financial charges is only possible if authorized by the Owner.
3. Responsibilities & Obligations of Administrators / Management Companies
The Administrator and the Management Company expressly acknowledge and accept that:
- They act as legal representatives of the building or hold the relevant authorization from the General Assembly of owners.
- They bear exclusive responsibility for the accuracy, legality, and correctness of the data they enter into the Platform (such as expenses, participation quotas, minutes, receipts, debts).
- The Platform bears no responsibility for errors in the calculation of communal charges or for any legal/financial disputes arising from incorrect, incomplete, or fraudulent data entry on their part.
Separation of Brand Identity and Services Provided (Co-branding): To enhance user experience and clearly delineate roles, the Platform implements a co-branding policy. Each cooperating Management Company uploads and displays its own corporate logo within the interface, alongside the BMExpert logo. It is hereby made absolutely clear to end users that BMExpert provides exclusively the technological infrastructure (the software). We bear no relation, oversight, or legal responsibility for the quality of the physical management services (e.g., cleaning, conduct, physical presence) provided by the independent Management Company at the respective building.
4. Document Creation & Legal Disclaimer
The Platform provides digital tools for drafting lease agreements and recording minutes. By using these tools, the user acknowledges that:
- These tools constitute exclusively technological conveniences and/or templates and in no way substitute legal advice.
- The legal validity, accuracy, and binding nature of the produced documents rests exclusively with the will and responsibility of the contracting parties.
5. Payments, Financial Transactions & Fees
The Platform provides the ability to execute electronic payments, integrating Stripe as the payment processing provider. This feature supports:
- Payment of Platform usage fees or subscriptions.
- Payment of communal expenses by residents/owners to building management.
- Collection of rent from owners from their tenants.
Transaction Processing Fees (Platform & Processing Fees): To maintain security infrastructure and provide digital payment services, a software usage fee (platform fee) is retained upon completion of electronic transactions within the Platform. This fee amounts to 1% on communal expense payments and 0.25% on rent payments, plus the applicable processing charges of the provider (Stripe). The total amount is always calculated and displayed with full transparency to the user before the final payment confirmation.
Off-Platform Settlement: An alternative option is available to settle debts (such as communal charges or rent) using means outside the Platform (e.g., cash, bank transfer). In such cases, the Platform acts exclusively as a recording tool, confirmation of settlement is performed manually by the respective beneficiary, and no fees or charges whatsoever are imposed by the Platform.
6. Maintenance & Communication
The Platform may suggest or display lists of external technical partners or professionals for maintenance repairs. It is expressly clarified, however, that the Platform disclaims any legal or financial responsibility regarding the quality, safety, charges, or timely execution of the required maintenance work, which rests exclusively with the selected professional.
7. Code of Conduct and Acceptable Use
It is strictly prohibited to use the Platform to post, transmit, or share content that is offensive, threatening, defamatory, racist, or in any way unlawful. Attempts to disrupt the Platform's operation through malicious software are also prohibited. We reserve the unilateral right to immediately suspend or delete accounts that violate these rules, without prior notice.
8. Intellectual Property
All content, source code, design (UI/UX), and logos of the Platform are the exclusive intellectual property of the BMExpert team. Reproduction, copying, or commercial exploitation thereof is strictly prohibited. Conversely, users retain full intellectual property rights over the data and documents they themselves upload to the Platform.
9. Personal Data Protection (GDPR)
The collection and processing of personal data is governed by the General Data Protection Regulation (GDPR). With regard to the data of residents of a building, the Management Company and/or the respective Administrator bear the status of “Data Controller”, while BMExpert operates exclusively in the capacity of “Data Processor”.
10. Limitation of Liability
The Platform is provided “as is” and “as available”. To the maximum extent permitted by applicable law, we disclaim any liability for direct, indirect, actual, or consequential damages that may arise from the use of or inability to use the Platform. In any case, our total liability to you may not exceed the total amount you have paid us for use of the Platform during the last twelve (12) months.
11. Governing Law & Jurisdiction
These Terms of Service are governed by, interpreted, and applied in accordance with the laws of the Republic of Cyprus. For the resolution of any dispute arising from the application or interpretation of these Terms, the Courts of Cyprus shall have exclusive jurisdiction.
